NOTICE OF PUBLIC HEARING - FILE NO. A-2024-02

TAKE NOTICE THAT an application under the above file number will be heard by the Committee of Adjustment on the 29th day of January 2024 at 8:30 A.M. at the Township of North Stormont Municipal Office, 15 Union St., Berwick, ON, under the authority of Section 45 of the Planning Act.

THE PURPOSE OF THE APPLICATION is to permit relief from Section 3.22 of Zoning By-law No. 08-2014, which requires all new lots to comply with the Minimum Distance Separation I (MDS I) formula. The proposed location of the new residential dwelling on the subject lands does not meet the MDS I setbacks required from an existing unoccupied livestock barn and manure lagoon (not in use) at 14698 County Road 43.

THE EFFECT OF THE APPLICATION is to:

  1. Reduce the MDS I setback required between the new residential dwelling and an existing livestock barn (currently unoccupied) from 216 metres to 95 metres, and;
  2. Reduce the MDS I setback required between the new residential dwelling and an existing manure lagoon (not in use) from 333 metres to 95 metres.

The proposed reductions will allow for a dwelling to be constructed on the lands.
